I have not been formally charged with anything as of yet. I am being accused of perjury, and falsifying information to police. However, during my initial questioning, the police never told me to have a lawyer present. I was never read my miranda rights before being arrested. I was forced to answer questions that I didn't want to, but thought cooperation was best. Is this a civil rights violation? I have a clean record.

As a Delaware criminal defense lawyer for 30 years, we have seen this issue arise many times.In a custodial interrogation setting Miranda rights MUST be read and explained to you, and if you invoke your right to silence or attorney, questioning must cease.
