Legal Question in Bankruptcy in Virginia

Chapter 7 Filing- Filed and discharged 2002

My husband and I are losing our house.. We never thought that we would be in this situation again. My husband filed bankruptcy in 2002. When can he file bankruptcy? I have seen 6 and 8 years.

Please advise

Depends on what chapter he filed and what the goal is. He can file now, but may not get a discharge. Assuming a chapter 7 in 2002, he can get a discharge in a Chapter 13 at this time (the minimum is 4 years), but not a 7 (7 to 7 is 8 years). If the prior case was a 13, it's 2 years to another 13, or 6 years to a 7.
