Power of Attorney

My husband is incarcerated in Stafford, VA 22555. I live in New York. He is trying to make me his Durable Power of Attorney. His mother just passed away this past Saturday and there is insurance money invovled. He has made several requests of the jail to help him file this form to no avail. His public defender said he doesn't handle this. How does he go about filing this form as soon as possible?

You will need to get a lawyer in or near Stafford, who is also a notary, to go into the jail and have your husband sign the power of attorney.

Ask the insurance company for a claim form. These forms are generally quite straightforward and easy to answer. No legal guidance should be required. I assume that you have, or can get, the insurance policy. If not, the insurance company will provide a lost policy affidavit.
