Legal Question in Consumer Law in Virginia

Law suite

We had a contract w/Terminix for 11 years. When we were selling our house the 1st buyers fell throuh due to extensive damage from termintes. We had to ake less on 2nd buyer because fo knowledge of fixed damage. Our question can we sue for Breech of Contract, Fraud , Property injury as well aspersonal injury. In other words what money can we sue for.

this was a Nightmare. It occured in Va Beach 23454

Whether you have a viable claim against Terminix depends upon your contract and the particular facts. Did they provide a disclaimer? A warranty? Whether you have a contract claim would depend upon the terms of the contract. To succeed on a negligence claim you would need to establish that they had a duty, that they breached it, and that the breach was what caused the problem (damage). In other words you would have to prove that they did not perform the service reasonably and that this was the cause of the harm you suffered.
