Stop The Harassments Please!!!

Under 15 U.S.C. Section 1692(c), Federal Debt Collection Practices Act, Section 805(c), if you have sent out a certified letter to a collection agency and they call you after receipt of the letter, what can you do?? Can you report them to the US Gov?? Thanks for the help.

You can sue the collection agency for the violation. I have seen that people sue, and win, under the FDCPA, so that they have to pay you. Since this could pay off whatever debt they are trying to collect from you, you should seriously pursue it. The difficulty of course is that the amount of money may not be enough to justify hiring a lawyer. If you sue for up to $15,000, you can sue fairly simply in general district court. Go to the clerk's office of the general district court in the county where you live. Ask the clerk to show you what forms to fill out and what lines you should fill out. If you ask for legal advice, they will refuse to give it. However, if you ask how to fill out the forms, they will tell you most of what you need to know.

You should also talk to Legal Services (reduced or free legal help) if you cannot afford an attorney.
