Legal Question in Credit and Debt Law in Virginia

How to get either my ticket or money?

Hello,

My visa was charged $ 882.81 ($15 included for Fed-Ex service) by www.1800Airdeal.com for a paper ticket and they never sent it and they refuse to refund me. I filed a dispute with Wachovia bank who didnt take any action. I filed a dispute with BBB who never responded for more than a month now. How to get my ticket or money? Thanks

You can file a claim in small claims court or general district court. Why do you say that this involves Virginia law? You will need to see if the company (try to find the REAL, legal name on their website or elsewhere, which might not be their marketing name or website address) has a registered agent in Virginia or an office in Virginia. The State Corporation Commission will tell you if they have a registered agent in Virginia.

You can bring a claim in small claims court up to $2000. However, there are no lawyers allowed in small claims court and a corporation MUST appear through an attorney. So the corporation will simply "remove" the case from small claims court to general district court. (A) If you want to annoy them (taking up more of your time in the process) you can start in small claims court and they will have to take the extra step of "removing" it. But more appopriately (B) you should simply start in general district court becuase that is where you are going to end up anyway.

It costs only about $38 to file a claim. If more money was at stake, I would suggest my assistance.
