Legal Question in Credit and Debt Law in Virginia

Wage Garnishment

My husband is having his paycheck garnished, my question is: Can the lawyer that is garnishing his wages hold his entire paycheck from him legally? I thought they could only take a percentage out of the check, not the whole thing.

Re: Wage Garnishment

If it's wages, it's subject to a cap of 25% of after-tax income unless the garnishment is for certain types of debts, including taxes and child/spousal support. If more is being withheld for regular commercial debts, it's probably the employer who is making the mistake.
