Legal Question in Criminal Law in Virginia

Two Class 4 Felonies

Charged with two class 4 felonies of flase pretenses and forgery. No prior criminal record at all. Have a public defender. Admitted to the detective that I did this. Any chance of getting some sort of sentence that does not involve doing jail time. Any advice will help. Regards

No active time on four felonies is a stretch. I'd say it depends on what exactly you did and how much you've messed up other people's lives. Forgery itself would get you a suspended 5 years sentence if you paid all restitution up front. The more angry the victim the worse the sentence after trial. A happy victim is a good result. You would of course be advised to make a plea deal to have most of the felonies dropped. I'd say you have a good chance of getting two dropped if you agree to plead guilty to two, agree to be sentenced on one and have one sentencing hanging over your head. Most fraud felonies have at least ten year sentences so you can expect any suspended sentence to be suspended for at least that long.

If you have no prior record the guidelines are probably going to come back somewhere between 3 and 6 months.

A good lawyer will have other ideas to make everyone happy by trial time.

Hopefully, your public defender will be skillful enough in her or his negotiations with the prosecutor to get at least two of the felonies dropped in return for your guilty plea and, perhaps, a suspended jail sentence.
