Legal Question in Criminal Law in Virginia

My fiance was with a couple buddies during a big drug deal. I pound of weed. The only thing that he had on him was a lighter. He full cooperated with the police. His bail was set at 3000 dollars. The officer who took the report wrote the wrong last name. He was charged with conspiracy to distribute marijuana. what would be a good way to approach this charge. Can he get off because the wrong name was written down?
