Legal Question in DUI Law in Virginia

I was on campus tonight at Virginia Tech and was stopped by two cops. They stopped me and my roommate because we were shouting at a friend who was in front of us. When they stopped us the asked if we had been drinking, we said no. They then asked if we would take a breathalyzer, we said no. At that point they wrote us up for underage possession, because they claimed we smelled of alcohol.

I have to go to court on January 20th. Do you have any suggestions for what I should say in order to get cleared of the charges?

I always advise one should retain an attorney. Especially with cases allegedly involving alcohol and drugs. But based on facts you have stated .....the police do not have a strong case against you. As long as those are the true facts...you may be able to settle prior to the trial.
