Civil lawsuit for car accident

Here's a little background first...

In September, my friend's car was taken without his permission by an aquaintance. This guy drove while intoxicated and totalled his car, but he was only charged with reckless driving and was noted as the one at fault for the accident only because my friend knew the officer and he talked him out of some serious charges. Since then my friend has been trying to settle things out of court with him to pay for the repairs of his BMW, which exceed $10k. He hasn't paid yet and my friend is taking him to court for a civil case.

Now here's the question...

The whole situation of whether or not this guy had permission to take the car is his word against my friend's, but the car was not insured at the time, so I was wondering if not having insurance on the car would be an issue in court. Also, he is an international student holding only a student visa, so what would happen if he could not pay the settlement? Would he get deported?

Failure to pay a court judgment is not a basis for deportation.(The entire question now under DUI and Drunk Driving law was previously submitted before in a slightly different form on 3-12-02 under the Immigration law category and was answered at that time.)
