Legal Question in DUI Law in Virginia

Create LLC after DWI for car

Quick question...this was mentioned to my by an attorney friend in IL not VA. After a conviction for DWI he suggested that I form an LLC and transfer ownership of the vehicle to the LLC and then re-register the car in VA under the name of the LLC. I'm self-employed so I was going to form an LLC anyway. However, he noted that if I encountered a random ''plate scan'' while driving during the hours and terms of my restricted license the car would show up with no connection to me or my restricted license and would be, thus, free from dealing with a traffic stop and having to show my license, travel log, and explain what business I was attending to.

If this makes sense please let me know and if you can provide the business services please let me know as well.

I suppose that could work for purposes of a "plate scan" but it would not work if you are stopped for some other reason and are required to present your drivers' license. Police in my area of northern VA are numerous and aggressive in traffic enforcement. Yes we do provide business services.

What you're proposing is kind of fraud which you

would hope to perpetrate upon the Virginia DMV and, in a larger sense, the criminal justice system which adjudicated your DUI and permitted you to have a restricted license. Fraud, whether civil or criminal, has a curious and unpredictable way of being found out---and appropriately punished.

Shame on you and your so-called attorney friend who first suggested this fraudulent scheme to you.
