Legal Question in Entertainment Law in Virginia

percentage cd sales

No longer a member of southern rock band..CD cut and released with my original artwork on cover and my participation as a playing member (percussion). Am I entitled to a percentage (there were six of us) of all sales of said CD since I left the band. (April 9,200). Sales are still going on - in record stores, etc. Did not sign anything -

I am not licensed in Virginia. This answer is based on general concepts of law.

Without a formal contract, in my opinion, what was the course of dealing (how where you getting paid) prior to your leaving? Did you have an oral agreement? Where any representations made to you by your band mates or management?

The answer to these questions are important.
