Legal Question in Family Law in Virginia

Child Support

I am a 25 year old married--name removed--who separated from my abusive husband by moving out December 2007. We share custody (not court ordered) of our 4 yr old son. I met and dated another man in December 07 to February 08. And yes we had consensual sex. I later met and started dating and having sex with a colleague in March 08. In April 08 I took a pregnancy test and it was positive. We only had unprotected sex once but only after I had asked him not to put another condom on when he returned from flushing the used one. In May I informed my partner who is also married and 18 years my senior of the pregnancy. He was not at all excited nonetheless. Needless to say he did not want another child considering he has three of his own, 22, 19, and 17. He like my husband whom I do not live with anymore is a retired military member. I informed my husband as I could not continue to keep this from him. He was not at all happy. Can I get child support from the partner? He wants a paternity test before making any commitment even though he went out and bought items on my baby registry for the unborn. He knows what I am going through and decided to do whatever he can. What should I do

Re: Child Support

Yes, you can file for a paternity test against this "partner" of yours in your local Juvenile & Domestic Relations District Court and for an order for child support in the event that he is found to be the father.
