Legal Question in Family Law in Virginia

exhusband in comtempt of court

exhusband refuses to pay his share of unremembursed medical expenses - he is not following the court order, what can i do?he will not respond to me at all when i send him the bills. he ignores me. no communication at all. the court order says he must pay 50% of any medical bill that is over $100.00. he now owes me $3500.00 amongst the back child support of 15k which he refuses to pay and i have to have DCSE take it when he does work. what can i do to get this money??? what is the process i need to go through? rule to show cause??? I do not have the resources for an attourney. so i have to do this on my own. please outline the steps for me

thanks

Michele

Re: exhusband in comtempt of court

Yes, you've hit upon it, a Rule To Show Cause(as to why this miscreant obligor should not be found in contempt of court and appropriately sanctioned). And given the persistent record of apparent willful and deliberate nonpayment on his part and without even the attempted courtesy of reasonable explanation, you should be asking for jail time (in my opinion).

Make sure, however, that the support matter has in fact been transfered into the Juvenile & Domestic Relations District Court from the Circuit Court if that is where it originated as part of a final decree of divorce. If it has not been transfered and is still within the jurisdiction of the circuit court, you should request a DCSE attorney to prepare and file the paper

work necessary to effect the aforementioned transfer so that you can then proceed to take appropriate enforcement measures on your own without the aid of an attorney.
