Guardian for two children

How would my daughter designate a guardian for her two children (ages 9 & 11).She has been divorced for 6 years, remarried in August 2002. Her ex has just been imprisoned for 7 years and 5 years probation on the charge of Pedophile. She went to court about two months ago to obtain full custody of her children. The judge granted her full custody. Can she make out a will naming a guardian for her children? Thank you.

Yes, your daughter could (and should) have a will drawn up which has a provision naming what Virginia refers to as a Standby Guardian for her children in case of her untimely death.

Your daughter may also want to request the booklet entitled "GUARDIANSHIP IN VIRGINIA"

available usually at local courthouses or from the Virginia Guardianship Association.
