Legal Question in Family Law in Virginia

rights

I have physical custody of my two granddaughters aged 10 and 5. The youngest one's father was convicted of rape on a minor. He has asked to live with me when he gets out, until he can get a job and find a place of his own. The mother has threatened to put both of us in jail and take the children away from me. Before he was incarcerated, he lived with my daughter and the children. Can she do this? What are his rights?

Re: rights

Well you have custody and have to make decisions in the best interests of the children. The choice to have a convicted child sexual prteditor live in the home with the children is not a responsible one. While you commit no crime, you put these children at unnecessary risk. The fact that they all lived together or you believe he would never commit crimes to his own children is besides the point. One of those children is not his and the rate of reoffending for sex offenders is atronomical. All in all a bad parental decision and the child's mother, if she is worthy, is likely to gain custody back.

I would advise against it.

Good luck
