Car Damages

Hello,

I was engaged with a guy for 5 years. About a year and a half before we broke up, he was driving my car and wrecked it. (legally, the car is my mothers.) With the money we got from the insurance company for buying back the car, and purchasing the new car there was a $5000 difference. My then fiance had a verbal agreement with my mother to make monthly payments to her to pay off the $5000 that had to be paid for wrecking the car.

A year late my mother had recieved NO payment from my ex, and he says he will not pay anything unless this is taken to court.

Will this hold up in court with no written agreement? Tell me what the outcome may be.

No one can tell you what the outcome will be. The outcome may be that she wins or that she loses. While I am not clear on what "difference" you are referring to, she might file suit in General District Court for breach of oral contract. She will need to subpoena any witnesses to the alleged oral (verbal) contract and what he said about being taken to court, etc. Good luck.
