Legal Question in Civil Litigation in Virginia

does he have a case
my friend was involved in a fight with another man. He was punched in the mouth all he did was put the other man on the ground until he stopped fighting him. No police report was done and the man didnt see a dr. he saw a dr. 4 months later and had to have surgery on his shoulder. he is blaming my friend and says he is going to sue him. His coworker says he was complaining about his shoulder for months before the fight. Does the man have a case to sue my friend or will he lose?

It depends on how the judge or jury see the facts -- I'm sure both sides have different versions of what happened.
