Legal Question in Civil Litigation in Virginia

Collecting a judgement

I won a judgement on appeal in the General District court for $2,750. The individual I sued has only sent me $1000.00 and it has been a month since court. He indicated on his envelope that this is one of four. There is no agreement for payment in installments. What can I do?

Re: Collecting a judgement

Assuming the judgment and judgment debtor are in VA (if not, you have to domesticate the judgment where the debtor or his assets are located), you can garnish his wages or bank account, levy on tangible assets, and/or require him to appear in court to answer questions about his assets (so that you can garnish or levy). This is time consuming, so if he does make payments, it may be your best approach just to let him pay it off.
