''Damage from lumber cart in retailers parking lot''

While shopping at a large retailer, my truck was damaged in their parking lot. An employee said that he saw one of their large steel lumber carts roll off of their sidewalk across the parking lot and into my new truck. They say they are not responsible for the damage. My question is are they responsible? If they are not liable, why?

Your remedy is in small claims court. Get an affidavit from the employee who witnessed the damage or, subpoena him, if necessary, to testify as to what he saw. You can file your claim and
