Legal Question in Civil Litigation in Virginia

Guardian as Pro Se

I am the Guardian for an adult who has been found by the court to be incompetent. Is there any prohibition against me acting pro se in a civil action since we have tried and failed to obtain an attorney? Please direct me to any case law against it as well as any exceptions that may be used.

Re: Guardian as Pro Se

That's a very interesting question. My guess

would be no, because you have a special status

as the agent of the person for whom you are guardian.

However, rather than gather opinions, I would urge you to contact the Virginia State Bar and ask for a formal opinion. If there were any problems, they would be the ones to cause the problems. So if you ask them directly, they should be able to tell you definitely how they would view it.

Go to: www.vsb.org

You might be able to get an opinion without giving your identity, if you wish.
