Can she do this?

My question is can my sister record on her answering machine that I DO NOT live at this address when in truth I do live at the address?

You have not really explained what is going on. Is she doing this to deceive someone else, or to annoy you?

If she or you are deceiving someone it COULD be fraudulent, but in most cases, it would be within your rights to say anything you want.

If you are paying for any of the costs of the phone it would be interfering with your use of the phone (ability to get phone calls incoming).

If you are sharing the costs of the home or apartment, it might to some small extent interfere with your use of your half of the home.

But if she is paying for the phone herself, the implication would be that it is her phone and you would wnat to get your own phone.

But if you don't want people to know where you live, I think you are free to say that as long as you don't have some legal obligation that you are hiding from.

Sounds like she can and already has. Now, if you are talking about suing her or threatnening to sue her, that might get her attention and cause a revision to her outgoing message. It is interesting that you don't say WHY she would do this.
