Legal Question in Civil Litigation in Virginia

request for insurance info

Our 29 yr okd son was involved in an injury causing auto accident while driving someone elses uninsured vehicle. the injured party's lawyer has had us (the mother and father) served with a supena demanding a copy of our auto insurance policy at the time. Our son was not residing at our home at the time of the accident nor was he listed as a driver of our vehicles on our policy. He has no insurance as he owns no vehicle at this time. Must we produce a copy of our policy and give it to the injuried party's lawyer? If we don't are we in contemp of court? Jail time for us? Why would we be responcible in any way for a 29 year old son who does not reside with us? The injuried party's uninsured motorist coverage paid her damages. P.S. the vehicles owner also had no insurance coverage. Help!

Your response to the attorney's subpoena should be just what you've said here, i.e., that neither you (nor by implication your insurance carrier)) is in any way responsible for your 29 year old son's alleged civil liability resulting from this accident and consequently you will not be forwarding a copy of your auto insurance policy and, if need be, you'll be happy to put the matter before the court and have the judge rule on it.
