Legal Question in Insurance Law in Virginia
Claim settled???
I filed a homeowners claim 5 months ago because someone broke into my house and stole property. I spoke with the agent and submitted the required documents and we agreed on an amount. I received a check in the mail 3 months ago for the actual cash value. I had 180 days to replace the items however i did not...well i replaced them with cheaper items. A few days ago I received a letter from the insurance companies lawyers stating that i must appear for an examination under oath next month. How is this possible? I thought that once an agreement is made and paid the claim is accepted. The letter say the claim is neither accepted or denied but under investigation. Do I have to attend this examination? They want me to resubmit the claim info and provide financial documents like bank and crddit card statements. I need to know my rights

You should consult with an attorney who can review the documents, including the agreement, to determine what your reasonable options may be.
