Legal Question in Insurance Law in Virginia

Life Insurance Benefits Denied

The Federal Employees Group Life Insurance (FEGLI) Agency approved a claim that I filed for my mothers death benefits and sent me the money. I thought they had made a mistake, because the sum was more than I was expecting and my sister should have received 50% of the proceeds, so I called the FEGLI. They told me that they had in fact made a mistake and I should send the money back to them, because they had paid me on the basis of my mother's beneficiary designation, dated 2004, where both my sister and I were equal beneficiaries. But then they told me that they should have paid on the most recent designation form, dated October 17, 2008. I was also informed that I was NOT the beneficiary of that form and was not entitled to any of the money. I sincerely believe that my mother did NOT change her beneficiary designation of her own free will, since she was profoundly disabled at the time and I believe that I can prove that she was not of sound mind. She died only 2 months later. How can I dispute this beneficiary designation?

Since I received this money in good faith, after complying with all the Federal regulations required to claim it, am I required to send my half back? I am heartsick about this.

Re: Life Insurance Benefits Denied

Yes, you must return the money which the FEGLI claims was improperly paid to you, but you still should be able to dispute the beneficiary designation. (Ask for a copy of the form dated October 17, 2008, and go from there.)
