Legal Question in Insurance Law in Virginia

who is responsible my insurance or theres?

I have a daughter who at the time was a minor, she was allowed to drive her boyfreinds auto and she only had a learners. she wreck the truck and they took us to court claiming she stole the truck. the judge thru it out of court. my insurance says they wont pay for it and his is trying to sue us for 9 thousand dollars in damage who is responsible? the insurance companys or me the mother of the minor, she is now 18 help thanks
