landlord and tenant issues

My roommates and I have rented a townhome in Woodbridge, Virginia for about a year and a half. The landlord has called on Sept 2nd to inform that that the house is going under foreclosure. The owner left the country and failed to make payments. the landlord said I presume the morgage company said there was no way to ''save'' the house, but that he was still waiting to hear what the bank had to say. We have not yet recieved a written notice of eviction. The landlord also said ''it was up to us if we wanted to stay until October possible November and to let him know. Have the voicemail saved on my phone. The landlord also said he was going to mail back out rent for the month of Sept. and also our security deposti. Wanted to recieve advice on what we should do. The story just is not adding up. Thank you.

I would need more information to answer this. You refer to a "landlord" and an "owner"--are they the same person/entity? Why would a landlord refund money for a period when you are still in possession?

You are right that something is not adding up.

If you're on a yearly lease, any new owner of the property would take title subject to the lease; however, if it's now a month to month arrangement, then,

30 days advance notice to you is likely all that's required.

If the landlord happens to return your rent for the month of September(for reasons unknown) along with your security deposit, you'd be wise not to spend these funds but to put them safely in escrow while awaiting further notice and information.
