Billing fraud

If an attorney bills their client for a title search, but the attorney never conducted the title search themselves, nor paid anyone to do it. Is it legal to bill the client for fees never incurred?

It would not be ethical to bill for services not performed. Note that at least in urban areas in VA, most title searches are contracted out to abstracting companies. Are you sure that no abstractor did a search?
