Legal Question in Medical Malpractice in Virginia

Dying

My dad is in the hospital right now due to 14 years ago a doctor was supposed to have taken his appendix out ....he was having bad pains on wednesday night and my mom rushed him to the hospital ...the doctor had to perform surgery thrusday morning ...he has septic poison and they also had to remove 2 feet of his intestines and colin....he also took his appendix out .....it is on record showing that they was taken out 14 years ago ...the doc said this could have caused the holes in his intestines and caused him to be like he is now ...he migt not live ....do i have a case with this

It would certainly seem that your father(who is hopefully still alive)rather than you would have a malpractice claim against the doctor who allegedly nonperformed the appendectomy and, perhaps, the hospital as well where it was supposed to have taken place.

Many more facts, however, must be developed and you would be well advised to consult with an attorney who is competent to pursue this type of matter. (One major consideration, obviously, is whether the practitioner from 14 years ago is still alive and accessible.)
