Legal Question in Medical Malpractice in Virginia

Eye exam

I recently bought some new glasses at a pretty big name eye glass company because I had broken my previous pair. (I did NOT get an eye exam, I was simply getting new frames and ordering new lenses with the same prescription) When I got my new glasses I couldn't see out of them and after about a week of trying to ''adjust'' to glasses that should have been the same prescription as my old glasses, I gave up due and took them back. The company realized that they had put the wrong prescription in my PRIOR glasses, that I had been wearing 18 months! They decided to give me a ''free'' eye exam,and put the new prescription in my glasses. It has now been almost 4 weeks since I paid for the new glasses and I still do not have them! They say giving me a free eye exam was enough compensation, I feel like I should get more in return for this time and money I have wasted with them, not to mention I have been wearing an incorrect prescription for almost 2 years!! What can I do? I told them these concerns and they seem to show no concern, they say wearing the wrong prescription wouldn't of affected my vision in the long run, is this true? I would like to take this to court, but I am just a young college student, I dont have that kind of money

Give 'em a deadline to return your glasses with the new (and correct)precription lenses, and if you still don't have them by that date, sue them in small claims court for what you reasonably believe your damages to be.
