Legal Question in Medical Malpractice in Virginia

Suing a plastic surgeon?

I got a nose job about a year ago. I decided to do the surgery with the expectation that the appearance of my nose will be improved, however the surgeon did not fix the appearance. He only made it worse. I have had difficulty breathing ever since and also, prior to the surgery my nose was straight, however as a result of the surgery my nose was crooked and had deep dents in it. My surgeon told me that the reason this has happened is because of how I slept after the surgery. He told me that my nose will re-position itself and will straghten out on its own. It has been almost a year and I have not seen any improvements in the appearance. I contacted other doctors to get their opinion and they told me something else has happened. I wanted to know if I have the chances if getting my money from the doctor the back or if I sue him, will I have a good case and have the chance of winning the case? Please advise.

Re: Suing a plastic surgeon?

Much more information would be required to offer a

reasonable opinion on this matter. From a legal point of view, the bottom line consideration is whether the standard of care which you received

during the course of your nose job fell below the prevailing standard of care for this type of surgery in the community at that time and whether this substandard care which you allegedly received was the proximate cause for what you now consider your defective or less than acceptable appearance.
