Legal Question in Personal Injury in Virginia

My house was robbed twice within a week by the same perp in 2008. He is currently serving 4 years in jail. Can I file a civil lawsuit under the tort of conversion to recover some of our losses ( some which are ongoing such as our homeowners insurance being cancelled because of two claims in a 5 year period) and is there a statute of limitations?

Your chances of recovering any of your losses from the convicted

perpetrator now serving a sentence of four years incarceration for the

crime are probably around ZERO (unless the perpetrator was independently wealthy and had attachable assets).

But, yes, he could be sued and a special attorney appointed to represent him,

but it would likely prove for you(in my opinion) the proverbial fool's errand for you to undertake. The SOL on the charge of theft would likely be two years.
