Legal Question in Personal Injury in Virginia

My wife was visiting my mother in the hospital. My wife went to the 6th floor to look for my mothers teeth. When my wife was getting on the elevator, she stepped on a rubber band that was on the floor and it stopped my wife's foot and her body fell to the floor, dislocating her left shoulder.

4 days later she had to have surgery to put it back in place.

I had to miss 4 days of work and pay about $600 in copays.

Does the hospital have any responsibility for the injury?

There was a report filed with there security, but no one has called us.

Hard to say and to see how the hospital might be adjudged negligent for a rubber band that lay on the floor of one of the hospital elevators and which could've been dropped there a couple of minutes before your wife entered the elevator.

However, your wife could always file suit in small claims court for at least some of her damages(up to $5K) incurred as a result of her fall, and who knows, the hospital might decide to pay her some money for her losses in order to settle the matter.
