Legal Question in Personal Injury in Virginia

My niece has a heart problem, she had 2 surgeries but the problem was not corrected; she went back to see her cardiologist and they referred to a specialist out of state. This was surgery #3, after the surgery, she was told she would be ablet to live a normal life. Now, 3 months later, her cardiologist has informed her that there is a problem and something needs to be fixed. They wanted to do rush surgery on her and send her back out of state, but that is not feasible at this time. This is just a brief overview of the situation, are you able to give an idea of what recourse can be taken?
