Rear-ended at light, soft tissue

My wife was rear-ended while stopped at a light. Driver was going 35mph when he hit her on wet pavement but had .4 miles on slight downward slope + at least 15-20 sec to react. Driver cited with Reckless Driving at the scene. Our ins. says they will handle the damage to van but our claim against other driver's ins. Thus far have given recorded statement to our ins. Wife has obvious soft tissue been perscribed 10x therapy.

1) how likely can other driver plea down RD ticket?

2) Besides medical any idea what else to include when asking for settlement? Wife is stay at home mom w/ 3 kids.

3) Any ballpark figure to ask for?

Answers:

1. Depends on defendant's previous DMV record and whether he's represented by counsel;

2. Pain and suffering = to at least 3 x medicals;

Don't settle until it's reasonably certain what your wife's long term prognosis is likely to be.
