Legal Question in Personal Injury in Virginia

Sue third party not my employer

i work for the u.s. govt. and i had a accident or personal injury on a indepentent contractor property while they were at my place of emplyment. i have missed 10 days of work because of this injury. i would like to know if i can sue this independent contractor for lost of pay and pain and suffering, for negligence of not fixing or propertly inspecting their equipment. i also have 3 witnesses who saw the accident happen.

Generally speaking, you can sue a third party whose negligence injures you, even though you were working at the time. However, if you were out of work and received federal employees' compensation, the government has a potential claim for reimbursement of what they paid you and on your behalf for medical expenses.
