Puchased surveillance system from ebay

I purchased a surveillance system from ebay last fall. The first system did not work and the seller replaced it. The second system does not work now due to errors when it was re-built by the seller. The ebay listing says refund policy is 14 days from receipt of purchase and nothing else. Is it possible to bring a lawsuit if the seller does not replace or refund my purchase due to the time that has passed but the knowledge that the error is caused by their negligence?

If there was a writing evidencing the contract and it was executed in Virginia, then you would have five years from the date the contract was allegedly breached, to sue the seller for negligence in the courts of the Commonwealth.
