Legal Question in Real Estate Law in Virginia

Lis Pendens

After a lis pendens has been filed and recorded, how long does it remain in effect with the court? Forever? Is the filing attorney the only person who can cancel or release it? Is there a statute of limitations? Thanks!

Re: Lis Pendens

A lis pendens "lasts" as long as the case is pending. If no longer pending, it has no further implications, as it only serves to give notice of the pending litigation. It should be released to "clean up" the title, but it's no longer a cloud on title if the case is over. You can get the court to order it released, but that should not be necessary.
