Legal Question in Real Estate Law in Virginia

Loan Servicing

I'm going to foreclosure March 3rd and I never had any contact with a bank where I got my morgage from, they only come up as servicing companies, so who actually gave me the loan to get my home? The loan has been sold from one agency to another, so when I tried to refinance or modify they wanted nothing to do with it, so was it all a scam for the two years I so called was a home owner??

Re: Loan Servicing

This is one of the ways that you can challenge a foreclosure. Demand that they prove that they have "standing" to bring the foreclosure, by documenting whether they actually own the loan or someone else owns the loan.

I recommend that you call Norm Bradford at http://www.MortgageFraudExaminers.com on Sunday afternoon or Monday morning.

Re: Loan Servicing

Have you considered filing Chapter 13 bankruptcy to stop the foreclosure and give you a forum to assert your defenses? Feel free to contact us tomorrow or Monday to do this before the foreclosure.
