Legal Question in Real Estate Law in Virginia

What are my options?

I am living in a single family home with my now ex fiance. My name is on the mortgage loan and both our names are on the deed. Can I sell without his permission? Is he automatically entitled to any profit made upon selling the house? Can I remove his name from the deed? Can he be kicked out? Does he carry any financial responsibility by being on the deed?

Re: What are my options?

You cannot sell without his signature on the deed unless you obtain Court permission to sell through a partition action. Your share of the proceeds will be determined by the Court. You need to consult with counsel, ASAP.
