I recently began the process of buying a house and the loan fell through. The mortgage company wants us to pay for the appraisal, but when we recevied our copy of the appraisal the pictures attached were of my neighbors property. The appraiser states he cannot be sure he appraised the right property and now the mortgage company wants us to pay 575.00 dollars for the appraisal, but it is not of our property. The manufactured home company will not give us back our down payment until we pay for the appraisal. Is there anything we can do legally to get our money back?

Pay the lender for the appraisal. (Retain proof of payment.) Then send a written notice to the appraiser demanding a refund of the appraisal fee based upon his failure to perform

the appraisal upon the house for which it had been requested.

Then, if the appraiser refuses to remit the requested refund, proceed to file your case against him in small claims court which you can do for around $40.
