Legal Question in Real Estate Law in Virginia

Trustee sale; Vacate home?

My house is going up for auction on March 3rd and the trustee company says that we tech have to be out of the home that day, and if no ones buys it the bank will take it over and put it on the market, so my question is do we really have to be out that soon?

You can stay until they get a court order evicting you. If this is your house being foreclosed (rather than a rental), have you considered filing for bankruptcy to stop the foreclosure?

In addition to Dan's comments, make sure that there are no technical defects in either your mortgage or the foreclosure.

I have a case where a homeowner found technical defects and got the foreclosure thrown out. I don't know and I don't want to get your hopes up, but you should definitely check.
