Legal Question in Traffic Law in Virginia

About a month ago I was charged with underage possession of alcohol. I received alcohol classes, a small fine, and was assigned a probation officer. I was told my case would be reviewed in about 2-3 months (late august or early september) and the charge would be expunged from my record if i managed to stay out of trouble until then. Last night, an officer gave me another citation for underage possession. I stepped into the road outside my friend's house for just a second to see if another friend was still there. I had a nearly full beer in my hand at the time. My court date is at the end of may. Is there any way to have the charge expunged at this point or will the charge be on my record? What other advice can you give me?

Under the circumstances descirbed, it would seem unlikely that you would have

any of these charges expunged or given the disposition described in Va. Code Sec. 4.1-305F.
