Legal Question in Traffic Law in Virginia
I was pulled over for a brake light on November 3rd but my license was suspended at the time my court date is January 22nd my license was reinstated December 16th so when I show up to court im going to have my license will they re-suspend it or can they. My license was suspended back in june for an alcohol charge in the passenger seat of a car and has been dismissed. Will they seek jail time? Is it possible to just get a fine?

No, no jail time nor resuspension likely if this is your first offense of DWS (Driving While Suspended) and should not even result in a conviction unless it's clear that you had knowledge of this suspension (but drove anyway) and that the prosecutor could prove it beyond reasonable doubt (my opinion).
