Legal Question in Wills and Trusts in Virginia

Heir Property

There i heir property in th family anit is located in Louisa Co. Va. Taxes on the property were being paid by one of the heirs (my mother). This heir took over paying the taxes when her mother and aunt died (they were the daughters of the owner of the property). The property is spli between four parts (of heirs). The heir who was paying the taxes no longer wish to pay them (she is retired and elderly), and neither does any of the heirs.

Now the Treasury office (in VA) is telling her that she is behind in the taxes. Can she be liable for not paying. They are stating that her state income tax refund will be stopped or her Paycheck will be garnished (she is receiving a pension and does not live in Virginia). What grounds does she have?

Re: Heir Property

If there are four owners of record, each is jointly and severally responsible for the taxes on the property and the jurisdiction to which the taxes are owed may elect to pursue the delinquent amounts from either one or all of the owners until

the full amount of the unpaid bill(s) has been collected.

In addition to the collection remedies which you've already mentioned, the governmental entity to which the taxes are owed may also decide to have it sold at auction if the taxes continue to remain unpaid.
