Disabled Parking at Apartment

My wheel chair-bound mother rents an ADA compliant Section 8 apartment unit with a designated parking spot in front of her unit. Recently, the apartment manager has allowed another disabled tenant (who walks freely) to use my mother's parking spot because my mother doesn't own a vehicle. However, my mother does take taxis and receive rides from relatives who need the handicapped spot in question to transport her safely. When asked to move her vehicle out of my mother's spot by me, the other tenant parked elsewhere - but management has since encouraged her to park in mother's spot again. Today, management tore down the apartment designation off the handicapped spot. What recourse does my mother have? Thanks for all advice.

Your question is challenging. If I were the apartment manager, I would have solved the problem by designating a second disabled parking spot, not by doing what he/she did.

I recommend that you contact the discrimination arm of the federal Housing and Urban Dev. office in Seattle and ask to speak with one of their specialists. You can also contact the state Human Rights Commission, but I'd try the HUD office first.

In addition, check all the paperwork associated with your mother's rental of the unit. It's possible that she has contractual rights to that designated spot. Contractual rights would, of course, be different and separate from any anti-discrimination rights.
