timeshare

I have a trendwest timeshare and can't afford it. Is there anyway to get out of the contract without having leagel problems

Without looking at the contract, I can't give you anything but generalities.

You may be able to assign the contract - that is, find somebody else who wants to assume the responsibility in exchange for the benefits. Read the contract first, and see what it says about this.

You may be able to get out of it in exchange for some money to Trend west. Again, I don't have the contract in front of me so I cannot say for sure.

Obviously, they would like you to keep paying, and it sounds as though you may be having a hard time doing that. Whether or not your breach results in legal action depends on what it is worth to them to enforce the contract.

Do a risk-benefit analysis from their standpoint: Do you have deep pockets? How much do they stand to gain? Are you likely to declare a bankruptcy in the event that they pursue their remedies?

If you need more help, call your local Bar Association and ask for a referral to an attorney who does consumer rights litigation. They'll be able to read the contract and give you more specific advice.
