Legal Question in Criminal Law in Washington

Assault 3rd degree of a child

For sentencing purposes in this kind of case, 7 counts of the charge, does this change her offender score? Also, do aggrigating factors have to been determined by a jury. I have read the Sentencing manul, and it kind of jumps around on the subject. Right now, I am trying to figure out, without going to a jury trial, what her sentence would be if she pleads guilty (She plead not guilty at arraignment), What jail facility would this be served in? Would the First Time Offender waiver be an option as well? I apologize for all the questions on this matter. And I thank you for the responses.

Re: Assault 3rd degree of a child

Her attorney should be able to answer all of these questions but yes, multiply currently charged counts add to her offender score as if they were criminal history. So, 7 counts moves her seven steps across the chart to the right. If she gets prison time, over one year, she'll likely serve at the women's prison Shelton on Fox island (near Gig Harbor). If under one year, she'll serve at the local jail unless they have an agreement to house inmates elsewhere. Only the local jail will know that.

Often, multiple counts are threatened to get the accused to plead to one count. So, it is very nearly impossible for you or anyone else to predict her likely sentence. You'll need to speak with her attorney (or likely learn from her what her attorney is saying) in order to know her likely sentencing range.
