my sons lawyer made an error

My son, age 15 pleaded guilty to a class c felony and I wanted to go to trial. His lawyer, court appointed gave him the wrong advice and he took the fall. she will not talk with me now concerning this matter, her receptionist said she legally could not. Is this true or she does not want me to call her o her bum advice?

Your son is the client/defendant. Ultimately, your son and the attorney decide whether to go to trial or enter a plea. The attorney has no obligation to consult with you. That said, it's not a good practice to refuse to speak with the parents for many reasons. You should attempt to contact the attorney's supervisor (if there is one).

You could also consult a criminal defense attorney . . . get a second opinion, in other words. If you do so, you must provide as much information and documentation as possible to the attorney, i.e. police reports, witness statements, etc.

A parent will not always view a criminal case and the risks and penlties in the same way an attorney does. Perhaps it is best that you retain an attorney for a consultation. At a minimum, the attorney will be able to explain the reasons underlying the public defender's actions, and whether there are grounds for a formal complaint.

Whatever you do,act quickly. If appealing is a consideration, the notice of appeal must be filed within 30 days of the judgment and sentence.
